The Electronic Communications and Transactions Act (25 of 2002) (ECTA) provides that agreements for the sale of land (property) being a contract for the alienation of immovable property, as provided for in the Alienation of Land Act (68 of 1981, cannot be signed using an electronic signature or advanced electronic signature. If your “agreement”  does not meet the requirements as per the Electronic Communications and Transactions Act (25 of 2002) (ECTA) and the Alienation of Land Act (68 of 1981), the “‘agreement “‘ will be void, invalid and unenforceable.
